RESERVATION POLICIES

These Reservation Policies (“Reservation Policies”) establish the requirements, rules, procedures, and expectations applicable to reservations made with The Gathering Nook Collective, LLC (“The Gathering Nook,” “Company,” “we,” “us,” or “our”).
These Reservation Policies are incorporated into and form part of the Customer’s reservation agreement with The Gathering Nook and are intended to be read together with the Company’s Terms & Conditions and Cancellation, Rescheduling & Refund Policy.
By completing a reservation with The Gathering Nook, the Customer acknowledges that these Reservation Policies have been made available for review and agrees to comply with the policies applicable to the reservation.
1. RESERVATION CONFIRMATION
A reservation is not considered confirmed until the Customer has:
Completed the required reservation process;
Provided all required information;
Accepted the applicable Terms & Conditions and Reservation Policies; and
Successfully completed the required payment.
Submitting an inquiry, consultation request, availability request, or partially completed booking does not create a reservation and does not guarantee a date, time, location, Nook, package, enhancement, or availability.
Once confirmed, the reservation is subject to the Reservation Agreement and all policies incorporated into that agreement.
2. CUSTOMER INFORMATION
The Customer must provide complete and accurate information during the reservation process.
This may include:
Full legal name;
Telephone number;
Email address;
Reservation date and time;
Selected Nook;
Reservation location;
Number of guests;
Occasion or event information;
Requested enhancements;
Access information;
Accessibility needs or requested accommodations;
Service-animal notice, when applicable;
Special requirements; and
Other information reasonably necessary to prepare and provide the reservation.
The Customer is responsible for promptly notifying The Gathering Nook of any material change to information previously provided.
Providing false, incomplete, misleading, or materially inaccurate information may prevent The Gathering Nook from safely or properly providing the reserved services.
3. MINIMUM AGE REQUIREMENT
The person making a reservation with The Gathering Nook must be at least eighteen (18) years of age at the time the reservation is made.
The person making the reservation is responsible for the reservation, payment, compliance with these policies, and the conduct of the reservation party.
No person under eighteen (18) years of age is permitted inside the Nook during a reservation.
The Customer is responsible for communicating this age requirement to all members of the reservation party.
The Gathering Nook reserves the right to request reasonable age verification when necessary to confirm compliance with this requirement.
4. GUEST COUNT AND CAPACITY
The Customer must provide an accurate guest count during the reservation process.
The number of guests may not exceed the maximum capacity established for the selected Nook, package, location, or applicable law.
The Customer may not add guests after booking when doing so would exceed the applicable capacity or create a safety, location, or operational issue.
No person under eighteen (18) years of age may participate in or enter the Nook.
The Gathering Nook reserves the right to refuse additional guests when the requested number exceeds the safe or permitted capacity.
The Customer is responsible for ensuring that all members of the reservation party comply with these Reservation Policies.
5. ACCESSIBILITY AND ACCOMMODATION
The Gathering Nook is committed to providing an inclusive and welcoming environment and will make reasonable efforts to accommodate Customer and guest accessibility needs.
As part of the reservation process, the Customer will have an opportunity to identify any accessibility needs, mobility considerations, or other accommodations that may be relevant to the reservation.
Customers are encouraged to provide this information during the reservation process and as early as reasonably possible so that The Gathering Nook has an opportunity to evaluate the requested accommodation and determine how the Nook setup may be appropriately prepared.
The Customer is not required to disclose more personal or medical information than is reasonably necessary to communicate the accessibility need or requested accommodation.
The Gathering Nook will make reasonable efforts to accommodate disclosed accessibility needs; however, not every location, park, surface, pathway, entrance, or setup area will be accessible for every individual or circumstance.
Accessibility may be affected by factors outside The Gathering Nook's control, including:
Park or venue accessibility;
Terrain;
Grass;
Gravel;
Sand;
Mud;
Uneven ground;
Hills or slopes;
Steps;
Pathways;
Distance from parking areas;
Weather conditions;
Location-specific restrictions;
Permit requirements;
Available access routes;
Physical characteristics of the selected location; and
Other conditions outside the Company's reasonable control.
When an identified accessibility need cannot reasonably be accommodated at the originally selected location, The Gathering Nook may, when reasonably possible:
Recommend or offer an alternative setup location;
Modify the Nook setup;
Modify the placement or arrangement of furnishings or equipment;
Suggest an alternative access route;
Recommend a different available location;
Reschedule the reservation when appropriate; or
Discuss another reasonable accommodation that may allow the reservation to proceed.
Any modification must remain consistent with applicable location rules, safety requirements, available equipment, and the physical limitations of the selected location.
The Gathering Nook does not guarantee that every requested accommodation can be provided at every location.
If a requested accommodation cannot reasonably be provided because of the physical characteristics of the location, applicable law, safety requirements, location restrictions, or circumstances outside the Company's reasonable control, The Gathering Nook will communicate that limitation as soon as reasonably practicable and will make reasonable efforts to identify an alternative when one is available.
The Gathering Nook does not control the accessibility features, condition, maintenance, policies, or restrictions of third-party parks, venues, or public locations.
Nothing in this section is intended to waive, limit, or diminish any rights or protections provided to individuals with disabilities under applicable federal, state, or local law.
The Gathering Nook will evaluate accessibility requests individually and will work in good faith with the Customer to identify reasonable options whenever possible.
6. RESERVATION LOCATION
The Customer is responsible for providing accurate information regarding the requested reservation location.
The Gathering Nook may provide services at parks, private properties, venues, event spaces, or other approved outdoor locations.
The Customer understands that every location may have its own rules, restrictions, operating hours, permit requirements, capacity limitations, smoking and vaping restrictions, animal restrictions, food and beverage restrictions, parking requirements, accessibility limitations, and other requirements.
The rules of the selected location remain in effect and may be more restrictive than The Gathering Nook's policies.
The Gathering Nook reserves the right to decline, modify, relocate, postpone, or cancel a reservation when the selected location is unsuitable, inaccessible, prohibited, unsafe, unavailable, or inconsistent with the Company's equipment or operating requirements.
7. LOCATION PERMISSIONS AND PERMITS
Unless The Gathering Nook expressly agrees in writing to obtain a particular permit or authorization, the Customer is responsible for obtaining any permission, reservation, permit, authorization, or approval required by the selected location or applicable governmental authority.
A reservation with The Gathering Nook does not constitute permission or authorization to use a park, venue, private property, or other location.
The Customer is responsible for complying with all rules imposed by the property owner, park authority, municipality, venue, county, state, or other applicable authority.
If a required permit or authorization is not obtained, The Gathering Nook may be unable to provide the reservation.
8. ACCESS TO THE LOCATION
The Customer must provide The Gathering Nook with accurate information necessary to access the reservation location.
This may include:
Gate codes;
Parking instructions;
Property access instructions;
Venue contact information;
Security procedures;
Restrictions on vehicle access;
Building or property access information; and
Other information reasonably necessary for setup and teardown.
The Customer is responsible for ensuring that The Gathering Nook has lawful and reasonable access to the setup location at the scheduled setup time.
If The Gathering Nook cannot reasonably access the location because of inaccurate information, locked gates, unavailable parking, restrictions, lack of authorization, or other Customer-caused circumstances, the Company may be unable to complete the setup.
Such circumstances may be treated as a Customer-caused failure to provide access under the Cancellation, Rescheduling & Refund Policy.
9. PARKING AND TRANSPORTATION
The Gathering Nook does not guarantee the availability, proximity, cost, accessibility, or convenience of parking at third-party locations.
The Customer is responsible for any parking fees, parking restrictions, citations, tolls, or transportation costs associated with the selected location unless expressly stated otherwise in the Reservation Agreement.
The Customer should allow sufficient time to locate parking and reach the Nook setup area.
The Customer's inability to locate parking or transportation to the reservation location does not automatically create a right to a refund or rescheduling.
10. SETUP AND TEARDOWN
The Gathering Nook provides setup and teardown for applicable Nook reservations as described in the selected package.
Customers and guests may not begin using the Nook until setup has been completed.
Customers and guests may not:
Move the Nook;
Move structural components;
Dismantle the Nook;
Attempt to relocate the Nook;
Remove Company equipment;
Rearrange structural elements;
Unplug Company equipment; or
Interfere with setup or teardown.
The Gathering Nook reserves the right to modify the placement or arrangement of the Nook, furnishings, décor, equipment, or other elements when reasonably necessary because of safety, weather, location restrictions, equipment limitations, accessibility considerations, or other operational considerations.
11. SETUP AREA AND SAFETY CLEARANCE
The Nook setup may include an area surrounding the Nook that is required for setup, teardown, equipment, décor, access, safety clearance, or other operational purposes.
Customers and guests may not move, remove, obstruct, or interfere with Company equipment or items located within the designated setup area.
The Gathering Nook may restrict access to portions of the setup area when reasonably necessary for safety, equipment protection, setup, teardown, or operational purposes.
12. RESERVATION START AND END TIMES
The reserved time represents the Customer's scheduled use period and does not necessarily represent the total time required by The Gathering Nook for setup and teardown.
The Customer and guests must vacate the Nook and its immediate setup area at the scheduled end of the reservation.
Customers may not extend their reservation without prior approval from The Gathering Nook.
Additional charges may apply when additional time is requested and approved.
Unauthorized use beyond the scheduled reservation period may result in additional charges and may affect the Company's ability to accommodate subsequent reservations.
13. USE OF THE NOOK AND COMPANY PROPERTY
The Nook, furnishings, décor, equipment, lighting, textiles, and other items provided by The Gathering Nook remain the property of The Gathering Nook or the applicable owner unless expressly identified as a consumable, take-home item, or item purchased by the Customer.
Customers and guests must use all property responsibly and only for its intended purpose.
The following activities are prohibited:
Climbing on the Nook structure;
Hanging from structural components;
Standing on furniture;
Jumping on furniture;
Moving structural components;
Removing Company equipment;
Tampering with lighting or electrical equipment;
Unplugging Company equipment;
Misusing furnishings or décor;
Using Company property for purposes for which it was not designed; or
Any conduct that could reasonably damage the Nook, equipment, furnishings, décor, or location.
14. POWER STATION, LIGHTING, AND DEVICE CHARGING
The Gathering Nook may provide a solar-powered portable power station as part of the Nook setup for operating applicable lighting and other Company-provided equipment.
The power station is provided as part of the Nook setup and must remain at the Nook for the entire reservation.
Customers and guests may use the designated charging ports on the power station to charge personal electronic devices, including cellular phones, provided that such use does not interfere with the operation of Company-provided lighting or equipment.
The following rules apply:
The power station must remain inside the Nook or in the location designated by The Gathering Nook.
The power station may not be removed from the Nook or reservation area.
Customers and guests may not carry, relocate, disconnect, dismantle, or otherwise move the power station.
Customers and guests may not unplug Company-provided lighting or equipment without permission.
Customers and guests may not connect unauthorized equipment to the power station.
Customers and guests may not use the power station to operate cooking appliances, heaters, high-powered equipment, or any device that could create a fire, electrical, overheating, or safety hazard.
Customers and guests may use the designated charging ports for personal electronic devices such as cellular phones.
Personal charging devices must be used in accordance with the manufacturer's instructions and must not create a safety hazard.
The power station remains the property of The Gathering Nook at all times.
The Gathering Nook may restrict or discontinue use of the charging ports or power station when reasonably necessary because of low battery capacity, weather, overheating, equipment limitations, safety concerns, or other operational circumstances.
Any damage to, loss of, unauthorized removal of, or failure to return the power station or its components may result in financial responsibility under these Reservation Policies.
15. ELECTRICAL EQUIPMENT AND CUSTOMER DEVICES
Customers and guests may not connect personal electrical equipment to Company equipment without prior authorization.
The following are prohibited unless expressly approved in writing:
Heaters;
Cooking appliances;
High-powered electrical equipment;
Extension-cord modifications;
Power strips connected to Company equipment;
Devices that exceed the power station's intended capacity; and
Any equipment that may create a fire, electrical, overheating, or safety hazard.
Customers and guests may use designated charging ports for ordinary personal electronic devices such as cellular phones.
16. DAMAGE, LOSS, AND EXCESSIVE CLEANING
The Customer is responsible for damage to, loss of, destruction of, or unauthorized removal of The Gathering Nook's property caused by the Customer or any member of the Customer's reservation party, except to the extent liability cannot lawfully be imposed.
This includes, without limitation:
The Nook structure;
Furniture;
Rugs;
Cushions;
Pillows;
Blankets;
Tables;
Décor;
Lighting;
Power stations;
Charging equipment;
Serving items;
Decorative accessories; and
Other Company property.
The Customer may also be responsible for extraordinary cleaning, repair, removal, transportation, restoration, or replacement costs resulting from misuse, stains, spills, food waste, bodily fluids, intentional damage, animal-related damage, unauthorized removal, or other Customer-caused conditions beyond ordinary use.
The Gathering Nook may seek reimbursement for the actual and reasonable cost of repairing, restoring, cleaning, recovering, transporting, or replacing damaged, lost, stolen, or unauthorizedly removed property, subject to applicable law.
17. THEFT, UNAUTHORIZED REMOVAL, AND MISAPPROPRIATION OF COMPANY PROPERTY
All Nook structures, furnishings, décor, equipment, textiles, serving items, lighting, power equipment, accessories, and other property supplied by The Gathering Nook remain the property of The Gathering Nook or the applicable owner unless expressly identified as a consumable, take-home item, or item purchased by the Customer.
Customers and guests are strictly prohibited from taking, removing, concealing, retaining, transferring, or otherwise exercising unauthorized control over any property belonging to The Gathering Nook.
This prohibition applies to all Company property, including but not limited to:
Nook furnishings;
Cushions;
Pillows;
Blankets;
Rugs;
Tables;
Décor;
Floral arrangements;
Serving pieces;
Trays;
Lighting;
Lanterns;
Power stations;
Charging equipment;
Decorative signs;
Tabletop accessories;
Equipment;
Structural components; and
Any other item supplied by The Gathering Nook.
No Customer or guest may remove Company property from the Nook or reservation area without express authorization from The Gathering Nook.
A Customer or guest who intentionally takes, removes, conceals, retains, damages, or fails to return Company property may be responsible for the actual and reasonable cost of repair, replacement, recovery, restoration, or other resulting loss, to the extent permitted by applicable law.
The Gathering Nook reserves all lawful civil and other remedies available for property that is intentionally taken, withheld, damaged, destroyed, or not returned.
Nothing in this Policy limits The Gathering Nook's right to contact law enforcement or pursue other lawful remedies when circumstances may constitute theft, unlawful taking, conversion, criminal damage to property, or another violation of applicable law.
The Customer is responsible for the conduct of members of the Customer's reservation party to the extent permitted by applicable law and the terms of the Reservation Agreement.
Any Company property inadvertently removed from the reservation area must be returned to The Gathering Nook immediately upon discovery.
Items expressly identified by The Gathering Nook as consumable, take-home, or purchased by the Customer are excluded from this provision.
18. DAMAGE OR SECURITY DEPOSIT IS NOT A LIMIT OF LIABILITY
If The Gathering Nook requires a damage deposit, security deposit, payment authorization, hold, or other amount in connection with a reservation, that amount is intended solely as security for potential obligations and is not a maximum amount for which the Customer may be responsible.
The Customer's financial responsibility is not limited to the amount of any damage or security deposit.
The Customer does not acquire the right to damage, remove, lose, destroy, or retain Company property up to the amount of any deposit.
If the actual and legally recoverable cost of damage, loss, theft, unauthorized removal, repair, replacement, cleaning, recovery, restoration, or other Customer-caused loss exceeds the amount of any deposit or other amount collected or authorized, the Customer remains responsible for the remaining balance, to the extent permitted by applicable law.
For example, if a $100 damage deposit is collected and the actual recoverable cost of damage or loss is $500, the $100 deposit does not satisfy or limit the Customer's responsibility for the remaining $400.
The Gathering Nook may apply any applicable deposit toward amounts owed and may separately seek payment of any remaining balance through lawful means.
The existence or collection of a deposit does not prevent The Gathering Nook from seeking recovery of additional amounts when the Company's actual legally recoverable loss exceeds the amount of the deposit.
Nothing in this section authorizes The Gathering Nook to impose an amount prohibited by applicable law.
19. PRE-EXISTING DAMAGE AND CONDITION REPORTING
The Gathering Nook makes reasonable efforts to inspect the Nook, furnishings, equipment, and décor before each reservation.
Customers should promptly notify The Gathering Nook of any visible damage, missing property, malfunction, or unsafe condition discovered before or during the reservation.
Customers should not attempt to repair, alter, or correct Company property themselves.
The Gathering Nook will consider reported pre-existing conditions when determining responsibility for damage or loss.
20. FOOD AND BEVERAGES
The Gathering Nook does not prepare food as part of its standard Nook setup services unless expressly stated otherwise in writing.
Food and beverage enhancements, when offered, may be sourced from third-party businesses.
Customers and guests must comply with all applicable laws and location rules concerning food and beverages.
Customers may not bring cooking equipment, grills, open flames, or other prohibited items into the Nook or setup area.
Customers are responsible for promptly disposing of food waste and complying with applicable location requirements concerning food and trash.
21. ALCOHOL
The Gathering Nook does not provide alcoholic beverages as part of its standard Nook services.
Customers and guests must comply with all applicable laws and the rules of the selected location concerning alcohol.
Alcohol may not be consumed when prohibited by the selected location or applicable law.
The Gathering Nook reserves the right to terminate a reservation when alcohol-related conduct creates a safety concern, violates applicable law, violates location rules, or materially interferes with the reservation.
22. VAPING, HOOKAH DEVICES, SMOKING, AND OPEN FLAMES
The Gathering Nook permits handheld, non-flammable vaping and hookah devices that do not require an open flame, burning material, or charcoal for operation, provided that their use is permitted by the selected location and applicable law.
Hookah devices that operate without an open flame or burning charcoal may be permitted.
The following are strictly prohibited inside the Nook and within the Nook setup area:
Hookahs or hookah devices that require charcoal;
Hookahs or hookah devices that require an open flame;
Hookahs or hookah devices that require burning material;
Charcoal burners;
Coal-heating devices;
Open-flame smoking devices;
Devices that require combustion to operate;
Incense or burning materials;
Candles, unless expressly approved in writing and permitted by the selected location; and
Any device or activity that creates an unreasonable fire, heat, smoke, combustion, or safety hazard.
FLAME-DEPENDENT HOOKAHS ARE STRICTLY PROHIBITED.
Any hookah or smoking device requiring charcoal, coal, an open flame, or burning material to operate may not be used at the Nook under any circumstances.
A handheld hookah or similar device that operates without charcoal, coal, an open flame, or burning material may be permitted, subject to:
The device being permitted by the selected location;
Compliance with all applicable laws and regulations;
The device not creating an unreasonable fire, heat, smoke, or safety hazard; and
The Gathering Nook's reasonable safety requirements.
The Customer is responsible for knowing how the device operates and for ensuring that any permitted device complies with this Policy.
If The Gathering Nook determines that a device presents a safety risk or violates the rules of the selected location, the Customer or guest will be required to discontinue its use immediately.
If the selected park, venue, property owner, or governing authority prohibits vaping, hookah use, smoking, or similar devices, that prohibition controls regardless of whether the device uses a flame.
23. OPEN FLAMES AND FIRE SAFETY
Open flames are prohibited unless expressly authorized in writing by The Gathering Nook and permitted by the selected location and applicable law.
This includes, without limitation:
Candles;
Sterno or similar heating devices;
Charcoal;
Fire pits;
Grills;
Torches;
Sparklers;
Fireworks;
Incense;
Open-flame cooking devices; and
Other flame-producing equipment.
The Gathering Nook may prohibit any item or activity that it reasonably determines presents a fire, heat, smoke, or safety hazard.
24. SMOKING
Smoking is prohibited inside the Nook.
Any smoking outside the Nook must comply with all rules of the selected location and applicable law.
Smoking must not create smoke exposure, fire risk, damage, or disturbance affecting the Nook, Company personnel, guests, members of the public, or surrounding property.
25. PETS AND ANIMALS
The Gathering Nook maintains a NO-PETS POLICY INSIDE THE NOOK.
Ordinary pets, companion animals, emotional-support animals, comfort animals, therapy animals, and other animals that do not qualify as service animals under applicable law are not permitted inside the Nook.
Pets may be present at the general outdoor location only when permitted by the selected location and applicable law.
When permitted at the location, pets must remain outside the Nook and outside the designated Nook setup area as directed by The Gathering Nook.
Pets may not be placed on or allowed onto:
Nook furniture;
Cushions;
Pillows;
Blankets;
Rugs;
Tables;
Decorative furnishings; or
Other Company property.
26. SERVICE ANIMALS
The Gathering Nook will accommodate qualifying service animals as required by applicable federal, state, and local law.
For purposes of the Americans with Disabilities Act (“ADA”), a service animal generally means a dog that has been individually trained to perform work or tasks directly related to a person's disability.
Emotional-support, comfort, companion, and therapy animals are not service animals solely because they provide comfort or emotional support under the ADA.
Customers are encouraged to notify The Gathering Nook during the reservation process if a service animal will accompany the reservation party so that the Company can appropriately prepare the Nook setup.
The Gathering Nook will not require service-animal certification, registration, a vest, identification card, medical documentation, or similar documentation when such documentation may not lawfully be required.
When permitted by applicable law and when the animal's service-animal status is not apparent, The Gathering Nook may make only legally permitted inquiries regarding whether the animal is required because of a disability and what work or task the animal has been trained to perform.
The Gathering Nook will not ask about the nature or extent of a person's disability.
Service animals must remain under the control of their handler and must comply with applicable law and reasonable safety requirements.
The handler is responsible for the care, supervision, and control of the service animal.
Nothing in this Policy is intended to limit any rights or protections provided under applicable disability-access laws.
27. ANIMALS AND COMPANY PROPERTY
Except where prohibited by applicable law, the Customer may be responsible for actual costs associated with damage to Company property caused by an animal, including cleaning, repair, or replacement costs, to the same extent the Customer would be responsible for comparable damage caused by a person.
The Gathering Nook will not impose an additional fee solely because a qualifying service animal accompanies a Customer.
The Customer remains responsible for the service animal's care, supervision, and control.
28. CUSTOMER AND GUEST CONDUCT
Customers and guests must behave respectfully, safely, and lawfully throughout the reservation.
The following conduct is prohibited:
Violence;
Fighting;
Threatening behavior;
Harassment;
Intimidation;
Illegal activity;
Intentional property damage;
Dangerous behavior;
Disorderly conduct; or
Any conduct that creates an unreasonable safety risk.
The Gathering Nook may terminate a reservation when Customer or guest conduct creates a reasonable safety concern or materially interferes with the Company's ability to provide the reservation.
A reservation terminated because of prohibited Customer or guest conduct is not automatically entitled to a refund and remains subject to the applicable Reservation Agreement and Cancellation, Rescheduling & Refund Policy.
29. EMERGENCIES AND SAFETY EVENTS
In the event of an emergency, dangerous weather, fire, medical emergency, security threat, hazardous condition, or other situation requiring immediate action, The Gathering Nook may suspend, modify, relocate, or terminate the reservation.
Customers and guests must follow reasonable safety instructions provided by The Gathering Nook personnel.
When necessary, Customers and guests should contact appropriate emergency services.
The Gathering Nook does not provide emergency medical services, medical treatment, childcare, security services, or emergency response services.
30. PROHIBITED ITEMS AND ACTIVITIES
The Gathering Nook may prohibit any item or activity that presents a safety, fire, property-damage, sanitation, legal, environmental, or location-rule concern.
Prohibited items and activities may include, without limitation:
Weapons;
Fireworks;
Explosives;
Hazardous chemicals;
Open-flame devices;
Charcoal-burning devices;
Unauthorized cooking equipment;
Unauthorized electrical equipment;
Illegal substances;
Any item prohibited by the selected location; or
Any item or activity that The Gathering Nook reasonably determines creates an unreasonable safety risk.
31. PUBLIC LOCATIONS
When a Nook is installed at a public location, the Customer understands that other members of the public may be present.
Unless expressly stated otherwise in writing, the reservation does not provide exclusive use of an entire park, public area, trail, field, or other public property.
Customers and guests must comply with applicable location rules and must not interfere with other members of the public.
32. THIRD-PARTY PROPERTY
Customers and guests are responsible for damage they cause to property belonging to parks, venues, property owners, vendors, or other third parties, to the extent permitted by applicable law.
The Gathering Nook is not responsible for the condition, maintenance, accessibility, security, or policies of third-party property except as expressly agreed in writing.
33. RESTROOMS
The Gathering Nook does not provide restroom facilities as part of the Nook setup.
Customers are responsible for identifying and using restroom facilities permitted by the selected location.
The Nook and surrounding setup area may not be used as a restroom.
34. DECORATIONS AND CUSTOMER-PROVIDED ITEMS
Customers may not attach decorations, signs, balloons, lighting, tape, adhesives, hooks, nails, staples, or other items to the Nook, furnishings, trees, structures, or Company property without prior written approval.
The Gathering Nook may refuse any item that could damage the Nook, furnishings, equipment, vegetation, property, or location.
Customer-provided items remain the responsibility of the Customer.
35. CLEANUP AND TRASH
Customers and guests are expected to dispose of ordinary personal trash and food waste in designated receptacles and to remove personal belongings at the conclusion of the reservation.
The Gathering Nook includes ordinary cleanup as part of applicable setup services.
Extraordinary cleaning caused by misuse, excessive food waste, spills, stains, bodily fluids, animal-related conditions, intentional damage, or other Customer-caused conditions may result in additional charges as permitted under these Reservation Policies and the Reservation Agreement.
36. PERSONAL BELONGINGS AND LOST PROPERTY
Customers and guests are responsible for their personal belongings.
The Gathering Nook is not responsible for lost, stolen, misplaced, or damaged personal property except to the extent liability cannot lawfully be excluded or limited.
Customers should not leave valuables unattended.
Items found by The Gathering Nook after a reservation may be retained for a reasonable period for attempted return to the owner.
The Customer may be responsible for shipping or other reasonable costs associated with returning lost property.
Unclaimed property may be handled or disposed of in accordance with applicable law after a reasonable retention period.
37. DECOR, CONTENT, AND PROFESSIONAL PHOTOGRAPHY
Customers and guests may take personal photographs and videos during their reservation.
Professional, commercial, promotional, influencer, brand, or monetized photography or video production requires prior approval from The Gathering Nook.
The Customer may not use the Nook as a commercial photography or content-production location without prior written approval.
The Gathering Nook may photograph or record its own setup for business documentation, portfolio, advertising, or social-media purposes in accordance with its applicable privacy and media practices and any consent requirements.
Participation in a reservation does not automatically constitute consent to use an identifiable person's image for marketing purposes where separate consent is required.
38. RESERVATION TRANSFERS AND RESALES
Reservations are personal to the Customer and may not be sold, transferred, assigned, or resold without prior written authorization from The Gathering Nook.
The Gathering Nook may require the identity of the person making the reservation to match the information submitted during booking.
A Customer may not transfer a reservation to another person in an attempt to avoid applicable age, payment, cancellation, or other requirements.
39. COMMERCIAL ACTIVITY
The Nook may not be used for commercial sales, solicitation, advertising, fundraising, political activities, public events, or other commercial activity unless expressly approved in writing by The Gathering Nook.
Professional photography, commercial content production, brand activations, promotional events, and similar activities may require a separate agreement and additional fees.
40. THIRD-PARTY PRODUCTS AND SERVICES
The Gathering Nook may coordinate or provide third-party products and services, including food, floral arrangements, balloon décor, photography, and other curated enhancements.
Third-party providers may have their own policies, schedules, limitations, and requirements.
The Gathering Nook will make reasonable efforts to coordinate third-party services but is not responsible for matters solely within the control of an independent third-party provider, subject to applicable law and the Reservation Agreement.
41. PRODUCT AND DECOR SUBSTITUTIONS
The Gathering Nook reserves the right to substitute a reasonably comparable item when a particular product, material, décor element, floral item, balloon arrangement, food item, or other enhancement becomes unavailable.
Substitutions may be necessary because of supplier availability, weather, transportation, damage, product discontinuation, safety concerns, or circumstances beyond the Company's reasonable control.
The Gathering Nook will make reasonable efforts to preserve the overall aesthetic, quality, and purpose of the selected Nook.
42. WEATHER AND ENVIRONMENTAL CONDITIONS
The Gathering Nook provides outdoor setups and cannot control weather or natural environmental conditions.
Customers should dress appropriately for outdoor conditions and understand that outdoor locations may include:
Grass;
Dirt;
Gravel;
Mud;
Uneven terrain;
Roots;
Rocks;
Insects;
Pollen;
Heat;
Cold;
Wind;
Rain; and
Other naturally occurring outdoor conditions.
The Gathering Nook may modify, delay, relocate, reschedule, or cancel a reservation when weather or environmental conditions create an unreasonable safety risk or make the setup impracticable.
Weather-related cancellations and rescheduling are governed by the Company's Cancellation, Rescheduling & Refund Policy.
43. SAFETY AUTHORITY
The Gathering Nook reserves the right to make reasonable safety-related decisions concerning the setup, use, modification, relocation, or removal of the Nook.
Customers and guests agree to follow reasonable safety instructions provided by Company personnel.
A Customer may not require Company personnel to perform an act that they reasonably believe would create an unsafe condition or violate applicable law or location rules.
The Gathering Nook may refuse to provide or may discontinue any activity, item, or service that it reasonably determines presents an unacceptable safety risk.
44. CHANGES TO A RESERVATION
Requests to change the:
Date;
Time;
Location;
Nook;
Guest count;
Package; or
Enhancements
must be submitted to The Gathering Nook as soon as reasonably possible.
A requested change is not effective until confirmed by The Gathering Nook.
Changes may result in additional charges, availability limitations, substitutions, or other modifications.
Requests that constitute a cancellation or rescheduling are governed by the Company's Cancellation, Rescheduling & Refund Policy.
45. CUSTOMER RESPONSIBILITY FOR LOCATION RULES
The Customer acknowledges that The Gathering Nook's policies do not override the rules of a park, venue, municipality, property owner, governmental authority, or other applicable authority.
If a location's rules are more restrictive than The Gathering Nook's policies, the location's rules control.
The Gathering Nook may modify or decline any service that is prohibited by the selected location or applicable law.
46. COMPLIANCE WITH LAW
Customers and guests must comply with all applicable federal, state, and local laws, regulations, ordinances, and location-specific requirements.
The Gathering Nook does not provide legal advice concerning permits, park regulations, alcohol laws, food regulations, smoking or vaping restrictions, animal restrictions, accessibility requirements, or other laws applicable to a Customer's individual circumstances.
47. RESERVATION-SPECIFIC REQUIREMENTS
Certain Nook packages, locations, enhancements, services, or special arrangements may have additional requirements or restrictions.
Any additional reservation-specific requirements disclosed to the Customer during the booking process or contained in a written reservation agreement are incorporated into the Customer's reservation.
The Customer agrees to comply with any such requirements applicable to the selected Nook, location, package, or enhancement.
48. RELATIONSHIP TO OTHER POLICIES
These Reservation Policies must be read together with the following documents:
Cancellation, Rescheduling & Refund Policy
Privacy Policy
These documents collectively establish the terms applicable to the Customer's reservation.
If there is a conflict between these documents and a separately signed written agreement between the Customer and The Gathering Nook, the separately signed agreement will control to the extent of the conflict.
The Terms & Conditions govern the general contractual relationship between the Customer and The Gathering Nook.
The Cancellation, Rescheduling & Refund Policy governs cancellation, refunds, and rescheduling.
These Reservation Policies govern the operational requirements, rules, and expectations applicable to the Customer's reservation.
The Privacy Policy governs the Company's collection, use, storage, and disclosure of personal information as described therein.
49. CUSTOMER ACKNOWLEDGMENT
By completing a reservation with The Gathering Nook, the Customer acknowledges that:
The Customer has had an opportunity to review these Reservation Policies;
The Customer understands that these policies apply to the reservation;
The Customer agrees to comply with these policies;
The Customer is responsible for communicating applicable requirements to members of the reservation party;
The Customer understands that failure to comply with applicable policies may result in modification or termination of the reservation;
The Customer understands that damage, loss, theft, unauthorized removal, or other Customer-caused property loss may result in financial responsibility beyond any deposit or security amount collected; and
The Customer understands that any deposit or security amount is not a limitation on the Customer's responsibility for additional legally recoverable losses.
50. CHANGES TO THESE RESERVATION POLICIES
The Gathering Nook may update these Reservation Policies from time to time.
The version applicable to a reservation will generally be the version presented to and accepted by the Customer at the time the reservation is made, unless otherwise agreed in writing or required by applicable law.
Updated policies will be posted with a revised effective date.
